Tag Check is provided by Clear Blue Design ("we," "us," or "our"). These terms describe the rules for the Tag Check app, website, and related services. You accept them when you select an account action expressly presented as agreement to these terms, or otherwise expressly agree. If you do not agree, do not create an account or continue through an action requiring agreement. Our Privacy Policy explains our information practices; accepting these terms does not waive privacy rights or provide consent for unrelated data uses.
What Tag Check provides
Tag Check uses AI to suggest identifications of secondhand items, research estimated value ranges, compare a supplied tag price with an estimate, and organize a private collection of finds. An account and internet connection are needed for online features. Features and store availability can vary by device and region.
We supply an informational research tool. We are not a seller, buyer, broker, auctioneer, authenticator, professional appraiser, insurer, or representative of a manufacturer. We do not inspect, possess, certify, or establish ownership of items you photograph, arrange their sale, or participate in your transactions. Nothing in a result establishes an agency, fiduciary, professional-adviser, or appraisal relationship.
AI results and their limits
AI identification and value estimates may be wrong, including when a result sounds confident, contains a precise number, or cites a source. Do not rely on a result as the sole basis for buying, selling, valuing, authenticating, or using an item.
Results are probabilistic suggestions based on the information supplied and evidence available during processing. Photos and descriptions may not reveal relevant features. A result can mistake the item, maker, brand, model, material, age, origin, condition, rarity, completeness, or authenticity, and may omit defects, repairs, counterfeit indicators, or other important facts. Additional photos or answers may change a result but do not guarantee that it becomes correct.
Price ranges and comparisons are estimates, not verified market values, offers to buy, minimum prices, or promises of resale demand, proceeds, savings, or profit. Labels such as "underpriced," "fair price," "market," and "overpriced" compare your supplied price with the AI estimate; they do not establish actual market value. Versions using "below," "within," or "above" an AI estimate describe the same comparison. Colors, rankings, confidence indicators, and numeric precision do not certify correctness or quantify a reliable probability of success.
Online sources can be inaccurate, incomplete, stale, manipulated, unavailable, or about a different item. An asking price is not evidence of a completed sale. Even a reported sale may be unverified or not comparable. Geography, condition, authenticity, timing, currency, fees, taxes, shipping, and other transaction costs affect actual value and proceeds. A source link is not our endorsement or verification of the source or seller. Saved results are not continuously revalued, and we do not promise alerts when an estimate or linked source becomes outdated.
Verify before acting
Inspect the actual item, read the underlying sources, confirm important characteristics and prices independently, and obtain suitable professional advice for significant decisions. Do not present a Tag Check result as a certified appraisal or authentication, or as evidence that we guarantee an item or price.
Results are not suitable as a substitute for professional advice or formal valuations for insurance, tax, customs, estate or probate matters, collateral, lending, litigation, or investment decisions. We do not assess legal title, provenance, intellectual-property rights, legality of trade, or compliance with product rules.
Tag Check is not a safety inspection or recall check. Do not use it to decide whether an item is safe to operate, wear, consume, or give to a child. Check official recall information, manufacturer instructions, and applicable product requirements, and consult an appropriately qualified professional where needed. A favorable estimate is not clearance to use or resell an unsafe, prohibited, counterfeit, or recalled product.
You make your own purchase, sale, listing, and use decisions. These responsibilities and the limits of the service do not excuse our breach of obligations or remove rights or liabilities that applicable law does not allow the parties to limit.
Accounts and permitted use
You must be at least 13, meet any higher applicable minimum age, and have legal capacity to enter this agreement. If you are a minor permitted to use the service, a parent or legal guardian must agree on your behalf and supervise your use. Provide accurate account information, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity you authorize; this does not impose liability for events beyond your responsibility under applicable law.
Subject to these terms and applicable store rules, we grant you a limited, nonexclusive, nontransferable right to use the app and website for their intended purpose, including researching items for your own resale activity. Do not resell access to the service, bypass credit or access controls, automate abusive requests, compromise security, access another person's information, manipulate purchase or refund systems, or use the service unlawfully. Do not reverse engineer except where applicable law permits that activity despite this restriction. Do not use the service or its results to deceive a buyer or infringe another person's rights.
Your content and intellectual property
You retain your rights in photos, notes, and other material you submit. Upload only material you are entitled to share and avoid unnecessary personal or confidential information. You grant us and our service providers a nonexclusive permission to host, copy, transmit, transform, and process that material to provide and maintain the service, generate and refine results, display your collection, and handle support and security. This permission is limited to those purposes and the retention described in the Privacy Policy; it does not make your collection public or give us an unrestricted right to exploit it.
The app, website, branding, and service materials remain the property of Clear Blue Design or their respective owners. Subject to third-party rights, you may use your results for your own lawful purposes, but we do not warrant that generated content is unique, protectable, or free of third-party claims. No result grants a license to someone else's brand, design, photographs, listing, or other material. Product and company names belong to their respective owners; identifying or referencing them does not imply their sponsorship, certification, or affiliation with Tag Check. We may use voluntary product suggestions to improve the service without an obligation to pay for them; this does not expand our permission to use private uploaded content.
Free checks and paid packs
Each account currently receives one free item check per UTC day. It resets at midnight UTC, does not roll over, and is used before paid checks. A check is used when the first successful result is delivered for an item. Follow-up answers, notes, additional photos, and technical retries for that same item are included. A different item requires a new check.
There is no subscription. Optional packs currently contain 10, 30, 100 checks. Prices and availability are shown in the app before purchase.
Checks pay for AI processing and delivery of a result, not a verified identification, an accurate value, a particular level of confidence, or a successful resale. A technically successful result can be uncertain, have limited comparable evidence, or be wrong. Your rights concerning defective or undelivered services, including mandatory consumer remedies, remain intact.
Paid checks have no scheduled expiry while your account remains available. They are service credits, not money or an investment, and cannot be transferred between Tag Check accounts or redeemed for cash except where required by law. Deleting an item does not return its used check. Account deletion removes access to remaining checks; contact support about any unresolved balance before deleting your account. Statutory refund rights survive deletion where applicable.
We may change future pack offerings or free allowances with appropriate notice where required. A change does not retroactively reduce the quantity or agreed nonexpiry of checks already purchased. If we discontinue paid functionality, we will provide any remedy required by applicable law and store rules for unused paid services.
Payments, delivery, and refunds
Apple or Google processes purchases through its native payment system under its own terms. The checkout shows the current quantity, price, currency, and applicable tax before authorization. The signed-in Tag Check account receives verified credits and may differ from the store account used for payment.
Pending, failed, canceled, or unverified transactions may delay or prevent delivery. Contact hello@clearbluedesign.com if a charge has not produced the expected balance. Verified refunds, chargebacks, and reversals may remove the associated credits, subject to applicable law. Request refunds through the relevant store, or contact us for assistance. We do not promise discretionary refunds beyond the applicable store policy or legal requirements. Deleting your account does not itself cancel a transaction or initiate a refund. Nothing in these terms removes mandatory cancellation rights, guarantees, refund rights, or other consumer remedies.
Service changes, suspension, and deletion
We may maintain, update, or change the service and may interrupt access for maintenance, provider failures, security incidents, or other operational reasons. We do not promise uninterrupted availability or permanent preservation of every result; keep independent copies of information you need. We remain responsible for obligations that cannot legally be disclaimed.
We may restrict or suspend access where reasonably necessary to address a material breach, fraud, abuse, security risk, or legal requirement. Where reasonable and lawful, we will explain the action and give an opportunity to resolve it; urgent risks may require immediate action. Contact support if you believe a restriction is mistaken. Suspension does not remove any remedy you are entitled to by law.
You may stop using the service. Choose Settings → Delete Account and confirm to delete your account, or contact support if you cannot access the app. Deletion is permanent. The Privacy Policy describes removal from the active service and the limited records that can remain.
Third-party services and app stores
Sign-in providers, app stores, payment providers, and linked websites have their own terms and privacy practices. Their availability and content are outside our control, but using providers does not remove our legal responsibilities for our service or our processing of your information. Any transaction you make with a third-party seller is between you and that seller.
Apple and Google are not parties to these terms and do not provide Tag Check's identification or valuation service. Store terms and any applicable platform end-user license agreement also govern the licensed app. These terms supplement, and do not purport to replace, Apple's standard end-user license agreement where it applies. In a conflict, mandatory law and applicable platform requirements prevail to the extent necessary.
Warranty limitations
To the fullest extent permitted by applicable law, the service and its AI results are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and warranties arising from a course of dealing or usage of trade, to the extent they may lawfully be disclaimed. We do not warrant that an identification, description, comparable source, estimate, or recommendation is accurate, complete, current, or suitable for a particular transaction, or that the service will be uninterrupted, secure in every circumstance, or error-free.
This section does not override an express commitment we make to you, mandatory standards for providing digital services, or any warranty, guarantee, or remedy that cannot lawfully be excluded. Informational statements and support communications do not certify an item or create a professional appraisal unless we separately and expressly agree in writing to provide such a service.
Liability limits and preserved rights
To the extent permitted by law, Clear Blue Design and its personnel will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from the service, including lost profits, resale opportunities, anticipated savings, business interruption, or loss of data, even if advised that such loss was possible. This includes losses arising from reliance on an erroneous identification or estimate only to the extent that the applicable law permits their exclusion. Direct losses are subject to the limit below rather than automatically excluded by calling them consequential.
To the extent permitted by law, our total aggregate liability arising from or relating to the service or these terms is limited to the greater of US $100 and the amount you paid for Tag Check during the 12 months immediately before the event giving rise to the claim. These limits apply regardless of the legal theory and to related claims collectively, only where enforceable.
The exclusions and cap do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that applicable law does not allow us to exclude or limit. They do not reduce an express refund obligation or excuse unlawful handling of personal information where liability cannot be limited. If local law disallows a limitation, that limitation applies only to the lawful extent. Your mandatory rights remain in effect.
Responsibility for unlawful misuse
To the extent permitted by law, you will reimburse us for reasonable losses and costs finally awarded to a third party, or agreed in a settlement you approve, to the extent caused by your unlawful uploads, infringement of that third party's rights, or intentional misuse of the service. We will promptly notify you of the claim, allow a reasonable opportunity to participate in its defense, and take reasonable steps to limit loss. You are not required to reimburse us for our own fault, provider conduct for which we are legally responsible, ordinary permitted use, or your good-faith exercise of consumer or privacy rights. This paragraph does not require you to waive or pay for a valid claim against us.
Disputes and general provisions
Please contact hello@clearbluedesign.com with a description of a concern so we can try to resolve it. Doing so is voluntary and does not postpone a legal deadline, require a waiting period, or prevent a complaint to a regulator or court. These terms do not impose mandatory arbitration, a class-action waiver, or an exclusive court location. Applicable law determines governing law and jurisdiction, including any protections available in your place of residence.
If a provision is unenforceable, the remaining provisions continue to the extent lawful. Failure to enforce a provision immediately is not a waiver. We may transfer this agreement with the service to a successor that assumes our obligations, subject to required notice and your mandatory rights; this does not expand permitted data uses. Provisions that by their nature need to survive termination, including accrued payment obligations, intellectual-property protections, and applicable liability limits, survive only to the extent lawful.
Changes and contact
Updates apply prospectively. The effective date at the top identifies this version. We will provide appropriate notice of material changes and seek renewed agreement where required. Posting a revised page alone is not treated as your agreement where affirmative assent is necessary. We do not use an update to retroactively remove accrued claims or change an already completed purchase to your detriment. Privacy changes are also subject to the Privacy Policy and applicable consent requirements.
